Terms of Use for Portemonnaie

1. Scope
These terms apply to the use of the Portemonnaie iOS app (the "App"), provided by:

The App is licensed to you under Apple's Licensed Application End User License Agreement (Standard EULA): https://www.apple.com/legal/internet-services/itunes/dev/stdeula/
These terms supplement the Standard EULA. If they conflict, the Standard EULA prevails.
2. The App
Portemonnaie helps you record and reflect on your personal spending. All entries are stored locally on your device (see our Privacy Policy: https://portemonnaie.app/privacy/).
The App, including the Insights feature, provides general observations about the entries you make. It does not provide financial, tax, investment or legal advice.
3. Subscriptions
3.1 Adding new entries requires an active subscription. Without one, you can still view, export and delete your existing entries.
3.2 Subscriptions are purchased through Apple's App Store and processed by Apple. Prices, billing periods and any free trial are shown in the App Store before you buy.
3.3 Subscriptions renew automatically at the end of each billing period unless you cancel at least 24 hours before the period ends. A free trial converts into a paid subscription unless you cancel before it ends.
3.4 You can manage or cancel your subscription in your Apple Account settings. Deleting the App does not cancel your subscription.
3.5 Payments, refunds and any right of withdrawal are handled by Apple under Apple's terms. We have no access to your payment details and cannot issue refunds ourselves.
4. Your data and backups
Your entries are stored only on your device. We have no copy and cannot restore lost data. Data may be lost, for example, if you delete the App, lose or reset your device, or import a backup using "Replace All".
You are responsible for backing up your data, for example via the App's export function or your device backups.
5. Availability and updates
We aim to keep the App working and up to date, but we do not guarantee that it will be available at all times, free of errors, or compatible with every device or future iOS version. We may update, change or discontinue features, taking your legitimate interests into account.
6. Liability
6.1 We are liable without limitation for intent and gross negligence, for injury to life, body or health, under the German Product Liability Act (Produkthaftungsgesetz), and to the extent we have given a guarantee.
6.2 For slight negligence, we are liable only for breach of an essential contractual obligation, meaning an obligation whose fulfilment makes proper performance of the contract possible in the first place and on whose fulfilment you may regularly rely. In that case, liability is limited to the damage that is foreseeable and typical for this type of contract.
6.3 Otherwise, liability for slight negligence is excluded.
6.4 Liability for loss of data is limited to the effort that would have been required to restore the data had you made regular backups.
7. Statutory rights
Your statutory rights as a consumer, including warranty rights, remain unaffected.
8. Applicable law
These terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, this choice of law does not deprive you of the protection of mandatory provisions of the law of the country where you habitually reside.
9. Consumer dispute resolution
We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
10. Changes to these terms
We may update these terms when the App or legal requirements change. The current version is always available at https://portemonnaie.app/terms/. The date at the top shows when it was last updated.
11. Language
These terms are available in English and German. In case of discrepancies, the German version prevails.
